Terms of Service
These starting-draft terms set expectations for using Bookwake to reactivate leads and manage compliant outreach.
Service and acceptable use
Bookwake provides lead-reactivation tools and related operator support to help businesses follow up with prospects. You may use the service only for lawful business purposes and in accordance with these terms, the Privacy Policy, and applicable law. Service features and availability may change as the product develops.
Customer campaign responsibilities
You are responsible for the leads and campaign information you provide to Bookwake. You must use lawful lead sources, provide accurate and current campaign data, obtain any required permissions before outreach, and maintain complete opt-out and suppression records. Do not upload or ask Bookwake to contact people when you lack the authority or legal basis to do so.
TCPA, calls, SMS, and email
Before any outbound calls or SMS, you must obtain and retain the legally required consent for the intended recipient, number, sender, message, and purpose. Before email outreach, you must have the permission or other lawful basis required for the message and applicable jurisdiction. You must also:
- identify the sender and the purpose of the outreach;
- disclose applicable message and data rates and expected message frequency;
- honor STOP, HELP, and other revocation requests for SMS or calls;
- provide a functional email unsubscribe path and process unsubscribe requests promptly; and
- never make consent a condition of purchase where applicable law prohibits that practice.
You are responsible for applying the correct consent and disclosure requirements to each campaign, including requirements that may apply under the Telephone Consumer Protection Act (TCPA), state law, or other rules.
A2P 10DLC registration
For applicable messaging to US mobile numbers, you must use the required A2P 10DLC brand and campaign registration process and provide accurate business, sender, use-case, and campaign information. Registration, approval, throughput, message delivery, or deliverability is not guaranteed. You remain responsible for keeping registration details accurate and for complying with carrier and messaging-provider requirements.
Do Not Call and suppression controls
Before any outbound call or SMS campaign, you must scrub the intended audience against the National Do Not Call Registry, applicable state Do Not Call lists, and your entity-specific or internal Do Not Call and suppression lists. You must retain evidence of consent and suppression checks, honor opt-outs, and promptly update your records. If those controls or records are missing, incomplete, or unavailable, you must suspend the relevant outreach until they are restored.
Data handling and account security
You authorize Bookwake to process lead data lawfully as needed to provide the service and related support. Bookwake may rely on necessary hosting, database, email, and platform providers to operate the service. Each party must protect its credentials and the data it controls using reasonable safeguards and promptly address suspected unauthorized access. Retention and deletion of demo-request information follow the Privacy Policy and applicable legal, accounting, dispute, or active-relationship obligations.
